This Liability Disclaimer applies to the use of Blind Report, a survey platform operated by Oxygen365 Ltd(“we,” “us,” or “our”). By accessing or using our services, you acknowledge and agree to the terms set forth in this disclaimer.

2. No Warranties

Blind Report is provided on an “as is” and “as available” basis, without any express or implied warranties.

  • We do not guarantee uninterrupted, error-free, or secure access to the platform.
  • We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the platform is free from malware, viruses, or other harmful components.

3. Limitation of Liability

To the fullest extent permitted by law, Oxygen365 Ltd shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:

  • The use or inability to use Blind Report.
  • Unauthorized access, security breaches, hacking, or data leaks.
  • Errors, inaccuracies, or AI-generated content within survey results and reports.
  • Third-party services, including ChatGPT API, x.AI for survey analysis, and Stripe for payment processing.

Where liability cannot be excluded, it shall be limited to the amount paid for services within the six (6) months preceding the claim.

4. User Responsibilities

Users, including survey facilitators and participants, are responsible for:

  • Ensuring the accuracy and legality of data they submit to Blind Report.
  • Compliance with GDPR, UK data protection laws, and organisational policies.
  • Keeping their login credentials secure and promptly reporting unauthorized access.

5. Third-Party Content & Services

BlindReport integrates with third-party services (e.g., ChatGPT API, x.AI API, Stripe), but we do not control or endorse these services.

  • We are not responsible for third-party data handling, compliance, or security.
  • Users acknowledge that third-party interactions are subject to their respective terms and policies.

6. Data Security & Breach Responsibility

We implement industry-standard security measures; however, we do not guarantee absolute protectionagainst cyber threats.

  • Users should take additional precautions (e.g., strong passwords, enabling two-factor authentication (2FA) where applicable).
  • In the event of a data breach, our responsibility is limited to notifying affected users and relevant authorities as required under UK GDPR.

7. Indemnification

Users agree to defend, indemnify, and hold harmless Oxygen365 Ltd from any claims, damages, or legal actions arising from:

  • Violations of laws, regulations, or third-party rights.
  • Misuse of Blind Report or data collected through it.

8. Governing Law & Jurisdiction

This Liability Disclaimer shall be governed by and construed in accordance with the laws of England and Wales.

  • Any disputes shall be resolved exclusively in the UK courts.

9. Amendments

We reserve the right to modify this disclaimer at any time. Continued use of Blind Report after changes are made constitutes acceptance of the updated terms.
